Subject: Rental of kitesurfing equipment through GoShaka or Next Level.
When renting kitesurfing equipment through GoShaka B.V. or Next Level (hereinafter "the Lessor"), you agree to the terms and conditions below. Please read these terms and conditions carefully as they describe your legal rights and responsibilities.
The renter (hereinafter "the User") is fully responsible for all damage to the rented kitesurfing equipment during the rental period, regardless of the cause of the damage. This applies to damage caused by improper operation, weather conditions, third parties, or other factors.
If the rented material is damaged, the User will reimburse the cost of repair. In the event that, in the Landlord's judgment, the rented material is beyond repair, the User will pay the current market value of the damaged material. The daily value will be determined by the Landlord, taking into account the age and condition of the material at the time of damage.
The Lessor shall not be liable for any bodily injury, property damage or other losses arising from the use of the rented kitesurfing equipment. The User accepts all risks associated with kitesurfing, including the use of the rented equipment.
The Landlord recommends that the User purchase their own insurance to cover any damages to rented equipment. This can be done through a NKV Membership.
Purchasing insurance is the responsibility of the User and not the Landlord.
The Lessor is not liable for damage to the Leased Equipment caused by acts of God, including but not limited to storms, unpredictable weather conditions or other natural disasters.
This agreement is governed by the laws of the Netherlands. Any disputes arising from or related to this agreement shall be submitted to the competent court in Amsterdam.,
