1. Definitions

General Terms and Conditions: these general terms and conditions;

Participant: person who participates in the Event;

GoShaka BV, registered in Amsterdam and with offices at Ohmstraat 7-3, 1098ST Amsterdam, Chamber of Commerce number 89186745;

Event: Downwinder by GoShaka in 2024. Also known as: Down the Wind Up the Coast, where participants complete a kitesurfing trip of approximately 60 km across the North Sea in one day;

Eventix: Ticket provider that handles tickets and payments;

Personal data: all data that can be traced back to natural persons.

Window: Period from May 1, 2024 to June 30, 2024 in which the Event can take place.

2. Applicability

1. These General Terms and Conditions apply to all aspects of the Event, including participation and the promotion of/to the Event. They contain the terms of the agreement between the participant and GoShaka.

2. Although GoShaka is responsible for the content of the Event and the Website, no rights can be derived from this.

3. GoShaka may change these Terms and Conditions at any time. The amended General Terms and Conditions apply from the date of publication on the Website. The Participant and/or Donor agrees to the applicability of the amended General Terms and Conditions by using the Website after that publication.

3. Registration conditions

1. The Event has a maximum number of Participants of 175. After reaching this number, registration for the Event is no longer possible.

2. Registration takes place via the Website and is only final after receipt of the registration fee. The registration fee is €85 (full Event + dinner & drinks) or €65 (full Event) and must be paid immediately upon registration. The registration fee covers the (in advance) costs of the Event and can only be transferred to another Participant via Ticketswap.

4. Transaction costs

1. Ticket provider Eventix charges transaction costs €1.00 including VAT.

5. Passage of the Event

1. The Event can take place once all required municipal permits have been issued.

2. The Event will take place within the Windraam. The final date depends on the weather conditions. There will be various Go/No Go moments beforehand. Communication about this takes place via email and social media.

3. If this proves necessary given the weather conditions, GoShaka has the option to reverse the route of the Event. This means that the starting point of the Event will be in Noordwijk and the finish in Hoek van Holland.

4. GoShaka reserves the right at all times to shorten, postpone and/or cancel the Event in the event of unexpected bad weather or other unforeseeable circumstances. Shortening, postponing and/or canceling the Event can, in the event of unforeseen circumstances, also take place after a GO moment.

6. Participation in the Event

1. Participation in the Event takes place on a voluntary basis and under the own responsibility of the Participant who has reached the age of 18 years or older on the day of the Event.

2. The Participant declares that he/she is aware of the fact that participation requires good health in both a psychological and physical sense, and declares that he/she meets this requirement and that he/she has sufficiently prepared for the Event through training and otherwise. Participant declares to have proper kitesurfing equipment, including sufficient protective wetsuit.

3. The Participant must at all times immediately follow instructions from the organization of the Event and/or the (local) authorities. In the event of unauthorized and/or irresponsible behavior, you may be excluded from (further) participation by the organization of the Event.

4. Participants are strongly advised to take out adequate insurance against any damage they may suffer or cause to third parties and/or third party property.

7. Mandatory phone in case of emergency

1. In order to contact the organization or emergency services via his/her telephone in the event of an emergency, the Participant is required to carry a telephone with him/her in a waterproof case.

8. Processing personal data

1. Personal data will be treated by GoShaka with the utmost care. GoShaka complies with the provisions of the General Data Protection Regulation, the Privacy Statement and the Cookie Statement. For more information about the processing of Personal Data, see the privacy statement on the Website.

9. Liability and Indemnification

1. Participation in the Event is always at the Participant's own risk.

2. GoShaka accepts no liability for any direct or indirect damage that could or has occurred to the Participant prior to, during or after participation in the Event. This exclusion of liability also applies to the cancellation or relocation of the Event and to serious types of damage, such as all possible types of damage resulting from injury or death.

3. GoShaka is not liable for theft, loss or damage to property of Participants or property of third parties.

4. The Participant indemnifies GoShaka against damage that it and/or third parties may suffer as a result of an act or omission attributable to a Participant with regard to the Event.

10. Other

1. Dutch law applies to these General Terms and Conditions. Disputes related to these General Terms and Conditions will only be submitted to the competent court in the district of The Hague, unless another court has jurisdiction based on mandatory law.
